A crime in the United States can be prosecuted federally when the alleged activity occurs in a federal jurisdiction or involves actors from multiple jurisdictions around the country. Crimes related to interstate commerce, for example, can be federally tried. In cases involving drug trafficking or related charges, mandatory minimums can apply. Generally, federal crimes are viewed as being more serious. 

Some of the more common federal crimes could include: 

  • Drug Crimes — Although many drug crimes are prosecuted by states, investigations involving such federal elements as the Federal Bureau of Investigation (FBI), the Drug Enforcement Administration (DEA), or similar agencies are typically automatically accelerated to federal charges. Also, cases involving the inter-state transfer of illicit substances can be tried federally. 
  • Weapons Crimes — These crimes revolve around the possession of illegal weapons. The use of weapons is often federally adjudicated. Furthermore, crimes that involve carrying weapons across state lines or that are investigated by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) can be federally prosecuted. 
  • Immigration Crimes — Federal agencies, such as U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement, control access to America’s borders. Immigration-related crimes, such as overstaying an expired visa, are processed by federal agencies. 
  • White Collar Crimes — From insider trading to money laundering to embezzlement, white collar crimes are often investigated and prosecuted by federal actors.
